Gumtree advertiser (952524119?) stole our 1911 Canada Mint Gold Sovereign photographs to use on Gumtree.Com, in competition with us. Totally dishonest, and stupid.
Copyright theft is dishonest, and contravenes Gumtree.Com rules:-
  • be false or misleading;
  • infringe any third-party right

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
This particular Gumtree.Com advertiser not only stole our images of a 1911 Canada Mint Gold Sovereign, he used it to sell his own coin on Gumtree.Com. He did not seem to think it was worth mentioning to potential buyers that his coin might not be in the same near mint condition, or be the same scarce mintmark, as in our photographs. This is almost certainly illegal in the UK under the Trade Description Act, although it appears to happen on a daily basis on parts of the internet.
It's possible he is ignorant of such fine points, or just plain ignorant.

It is always possible, even likely, that sellers who steal photographs do not own a similar coin, and have the intention to totally defraud potential buyers.
The vendor is not only cheating us by stealing our copyright images, he is fraudulently or ignorantly misleading and deceiving all potential buyers. Gaining pecuniary advantage by deception is the definition of fraud.

Price
The seller was asking a price of £120 for his coin,

Stupid or Crooked?
It looks as though it is free to post a "Classified" advert on Gumtree, and presumably they make their money on the featured advertising.
So, it cost the advertiser nothing, except some slight effort to post his advert. The effort seems to have been very slight, just 5 words, what an ignoramus!
It took us years to learn how to take such high quality photographs. We photograph carefully selected coins in the highest grades of preservation, then carry our post production work on the images (airbrushing), to make them look like supermodels while still retaining as much of their original character as possible.
What the advertiser seems to be unaware of is that he could have got more for his sovereign, even after postage, by posting it to us, and we would have paid him by return.

Too Cheap?
As he is asking less than an open market price for this coin, we wonder whether this indicates stupidity on the part of the advertiser, or dishonesty?
Let's assume the advertiser is not stupid, why would he offer the coin for less than he could get from a dealer? Is it stolen? Is the vendor a burglar, thief, fence, or what. Bearing in mind the anonymity which Gumtree appear to give their classified advertisers, it would appear highly likely that criminals would use the site to dispose of stolen goods.

Gumtree.Com Guilty of Negligence or Complicity
We have reported this example of copyright abuse using a Statutory Declaration via the Gumtree.Com fax line, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against Gumtree.Com for their negligence and / or complicity if they fail to take down the offending material promptly.
