eBay Cheats & Copyright Thieves
alex1237 in eBay Copyright Theft
alex1237 , of Slough, United Kingdom, stole our 1976 Austrian Babenberg Commemorative 1000 Schillings photographs to use on eBay, and failed to tell buyers the image was not of the same coin or coins he was selling, that the coin was a restrike. Totally dishonest!

eBay Copyright Thieves

We believe eBay profits from IP rights infringements (copyright theft), and does so knowingly, only removing infringing items reluctantly, if at all.

EINSETZUNG DER BABENBERGER
Who were the Babenbergs...?
Descended from a powerful Frankish family of the 9th century, they were amongst the most famous rulers of early Medieval Europe. The Holy Roman Emperor Otto II created Count Leopold of Babenberg margrave of the Eastern march (i.e. Austria) in A.D. 976. ('Margrave' is the German equivalent of the noble rank 'marquess'. The margraves guarded the frontiers of the Holy Roman Empire against Charlemagne). Among Leopold's successors were Leopold III (1073-1136), who became patron saint of Austria after his canonisation in 1485, and Henry II, the first Duke of Austria from 1156-1177. Duke Leopold V (1177-1194) took part in the Third Crusade but a quarrel with Richard I of England led to Richard's imprisonment in one of Leopold's castles. The 'Lionheart' was eventually freed but only after an enormous ransom had been paid.
Leopold VI (1198-1230) brought the Babenberg dynasty its greatest power and status. He married the Byzantine princess Theodora Angeloi, thus allying Austria with the powerful Byzantine Empire. Under Leopold's rule the Gothic style of architecture reached Austria - his palace of Klosterneuberg is known as the first Gothic building on the Danube.
End of the dynasty....
In 1251 Austria passed to Ottocar II of Bohemia, thus ending nearly 300 years of Babenberg rule. Under the Babenbergs, Austria had become prosperous and secure, maintaining friendly relations with its neighbours. The Babenbergs had achieved all this by using, amongst other things, intermarriage with some of the most powerful ruling families in Europe. It can be said that the Babenbergs were in part responsible for the multinational character of the later Habsburg empire.

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
This particular eBay seller not only stole our images of a 1976 Austrian Babenberg Commemorative 1000 Schillings, he used it to sell his own coin on eBay. He did not mention to potential buyers that the high quality photographs of a mint condition coin was not his own photograph, or that his coin may not have been in mint condition.
It's possible he is ignorant of such fine points, or just plain ignorant.
He also used the text content of one of our pages in its entirety, which also contravenes copyright law. He could have simply linked to our page. From his point of view, the disadvantage of this is that buyers could probably buy a mint coin from us for the same, or less, money.
It is always possible, even likely, that sellers who steal photographs do not own a similar coin, and have the intention to totally defraud potential buyers.
The vendor is not only cheating us by stealing our copyright images, he is fraudulently or ignorantly misleading and deceiving all potential buyers. Gaining pecuniary advantage by deception is the definition of fraud.

Price
The seller was asking a starting price of £50
He would probably get more by selling to us when eBay's new 10% selling fees are taken into account, even ignoring PayPal fees.

eBay Guilty of Negligence or Complicity
We will be reporting this example of copyright abuse using our standard Statutory Declaration via the eBay VeRO programme, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against eBay for their negligence and / or complicity if they fail to take down the offending material promptly.

We already have a page naming and shaming dealers using our images without permission. It's time we did the same for eBay, although if we include them all, this could be a very long page.
