eBay Cheats & Copyright Thieves
aardvark_linux in eBay Copyright Theft
aardvark_linux of Tamworth, NSW, Australia, stole our 1986 Chinese Gold Panda Obverse & Reverse Photographs to use on eBay, and failed to tell buyers it was not the same coin he was selling. Totally dishonest.

High eBay Feedback is No Guarantee of Integrity or Honesty
When we wrote this page, this eBay member's feedback was 125, with 100% positive, according to eBay.

eBay Copyright Thieves
Many eBay vendors use our coin photographs to sell inferior quality coins on eBay. These eBay members are dishonest and should be avoided.
We believe eBay profits from IP rights infringements (copyright theft), and does so knowingly, only removing infringing items reluctantly, if at all.

Sample Listing

1 oz solid gold coin (Chinese Panda)
I am selling this Chinese Gold Panda coin with NO RESERVE. It weighs one troy ounce, and consists of pure gold.
These are investment coins, much like Krugerrand or Maple Leaf.
I am selling another one, if you would like to buy two coins. See the other auction.
Here is a description of the coin:
The Chinese Gold Panda is a series of gold bullion coins issued by the People's Republic of China. The official mint of the People's Republic of China introduced the Panda gold bullion coins in 1982. The panda design changes every year (with a single exception) and the gold Panda coins come in different sizes and denominations, ranging from 1/20 troy oz. to 1 troy oz. (and larger ones as well).

On 07-May-10 at 03:05:53 AEST, seller added the following information:
Update on Friday 7 May: the gold price is now at $US1195 per ounce, which is $AU1335, and rising.

Questions and Answers About This Item

Q: hello, can you please provide larger close up pictures of both coins? Also, how did you come across these coins? cheers,
A: Hi I can't provide close-ups as I only have my laptop's webcam. These are straightforward investment coins that have no collector's value - people simply buy them for the gold content. I don't remember where I bought them - probably on Ebay, which is where people trade gold bullion for the most part. The link to the Wikipedia article should clarify.

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
This particular eBay seller not only stole our high quality 1986 Chinese Gold Panda Obverse & Reverse Photographs, he used them to sell his own gold pandas on eBay. He did not mention to potential buyers that the high quality photograph of the coin were not his own photographs.
It's possible he is ignorant of such fine points, or just plain ignorant.
It is always possible, even likely, that sellers who steal photographs do not own a similar item, and have the intention to totally defraud potential buyers.
The vendor is not only cheating us by stealing our copyright images, he is fraudulently or ignorantly misleading and deceiving all potential buyers. Gaining pecuniary advantage by deception is the definition of fraud.

Price
The seller was asking a starting price of AUD1 (One Australian Dollar).
Considering he can't remember where he bought the coins, perhaps he nicked the coins as well as our photos.

eBay Guilty of Negligence or Complicity
We will be reporting this example of copyright abuse using our standard Statutory Declaration via the eBay VeRO programme, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against eBay for their negligence and / or complicity if they fail to take down the offending material promptly.

Copyright Thieves on eBay
We already have a page naming and shaming dealers using our images without permission. It's time we did the same for eBay, although if we include them all, this could be a very long page.
