eBay Cheats & Copyright Thieves

macintosh_123 in eBay Copyright Theft
macintosh_123 of nowhere apparently (eBay listings normally show an item location based on the sellers address), stole our 1947 Mexican Gold 50 Pesos Obverse & Reverse Photographs to use on eBay, without our permission, to try sell his own coins, and failed to mention the coin in the photograph was not one of the coins he owned, if any. Totally dishonest.
Image theft is endemic on eBay, and most sellers appear not to care whether their buyers are deceived.

eBay Copyright Thieves
Many eBay vendors use our coin photographs to sell inferior quality coins on eBay. These eBay members are dishonest and should be avoided.
We believe eBay profits from IP rights infringements (copyright theft), and does so knowingly, only removing infringing items reluctantly, if at all.

Welcome to my auction for a
1947 Mexican Gold 50 pesos coins....
I have recently bought my house, During renovation of the property I found a small pouch bag with sixteen gold coins in it..
They are identical to the ones in the pictures below
have sixteen of them of which 15 are packed in individual pouches and one out of the pouch as i opened to examine it..
After Finding them I did my research on them on the net and what i found was that there where many of them on ebay and other websites and have found them valued at around £700 plus each,
I dont (sic) have any one (sic) who can examine or evaluate them so im (sic) putting them up for sale. They are concealed (sic) very well in a see through pouch individually and look in perfect condition with no dents scrapes etc..
I dont (sic) know nothing (sic) about gold coins or collectable items apart from what I have read on the internet, So here they are for sale, ill (sic) be happy to answer any questions and you are welcome to make your own enquires (sic)..
Im (sic) selling them sold as seen and am open to sensible offers..

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin and gold bar images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
It is always possible, even likely, that sellers who steal photographs do not own a similar bar, and have the intention to totally defraud potential buyers.
The vendor is not only cheating us by stealing our copyright images, he is fraudulently or ignorantly misleading and deceiving all potential buyers. Gaining pecuniary advantage by deception is the definition of fraud.

Price
The seller was asking for a Buy It Now price of £499.00 for his first 5 listings of these coins, which not surprisingly sold very quickly.
For his next 5 listings, he changed to an auction format at a starting price of £299, one of which still had a buy it now option at £499.

Stupid, Stolen, Imaginary, or a Combination
This eBay member, macintosh_123, may be one of the world's stupidest people. Each of his coins, if they are genuine, contain about £1,000 worth of gold at current prices. They are not the most popular gold bullion coin, but we would snatch his hand off at over £900 each for them. Perhaps his "research" was at a local jeweller's or at a "gold by post" rip-off website?
Another strong possibility is that he "found" the coins at somebody else's house, and they have not missed them yet, so he is trying to flog them as quickly as possible before the police catch up with him.
A third scenario is that the coins only exist in his imagination, and he is hoping that enough stupid and greedy people will send him money, and he can carper off to Brazil, or possibly just buy his next month's heroin supply .
Obviously, we cannot tell which, we can only guess. The truth may be a combination of two or more of these factors.

Will He Thank Us for Doing Him a Favour?
As stupid clot macintosh_123 "sold" his first batch of 1947 Mexican 50 Pesos at £499 each, he should be pleased to see that the first one he listed as an auction instead of Buy It Now sold for £1,111; meaning he will be £612 per coin better off, at least if he can sell them all at the higher price.
16 x £612 = £8,192
macintosh_123 could be over £8,000 better off thanks to our intervention.

eBay Fees
If macintosh_123 sells all 16 of his coin on eBay, he will pay 16 x 40 = £640 in eBay selling commission, plus listing fees of perhaps £2 to £3 per item. If buyers wish to pay via PayPal, this could add almost 5% more in PayPal charges, which would therefore be almost £25 per coin if they sold for £499 each (16 x £25 = £400), or over £50 each if they sold for around £1,100 each. (16 x £50 = £800).

Sales Proceeds
macintosh_123's nett sales proceed could be as little as under £7,000 assuming he sold them all at his £499 original Buy it Now price, and all buyers paid using PayPal.
If all 16 sold at £1,111 each (his highest auction bid), he would gross £16,776. Although the selling commission would still be the same (maximum £40 per item), and the listing fees would not change, the PayPal charges could be up to £800, meaning he still might only nett under £16,300. It is very unlikely that he would manage to sell all 16 at this high price, our own selling price is less than his high bidder was paying
We would have been happy to buy the lot at over £15,000 on the spot, subject to ID and evidence of ownership.
In all these calculations we have ignored postage.

eBay Guilty of Negligence or Complicity
We will be reporting this example of copyright abuse using our standard Statutory Declaration via the eBay VeRO programme, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against eBay for their negligence and / or complicity if they fail to take down the offending material promptly.
