eBay Cheats & Copyright Thieves

gillesc54 in eBay Copyright Theft
gillesc54 of Daveluyville, QC, Canada, stole our 1967 Canadian 20 Dollar Reverse Photograph to use on eBay, without permission to try sell his own 1967 Canadian 20 Dollar. Totally dishonest.
He failed to state or warn potential buyers that the superb condition full sovereign in our high quality photograph was not the coin you would receive, or that the photograph was a full sovereign when he was offering a half sovereign. This is deception.

Image theft is endemic on eBay, and most sellers appear not to care whether their buyers are deceived.

eBay Copyright Thieves
Many eBay vendors use our coin photographs to sell inferior quality coins on eBay. These eBay members are dishonest and should be avoided.
We believe eBay profits from IP rights infringements (copyright theft), and does so knowingly, only removing infringing items reluctantly, if at all.

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin and gold bar images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
It is always possible, even likely, that sellers who steal photographs do not own a similar bar, and have the intention to totally defraud potential buyers.
The vendor is not only cheating us by stealing our copyright images, he is fraudulently or ignorantly misleading and deceiving all potential buyers. Gaining pecuniary advantage by deception is the definition of fraud.

Price
The seller was asking a starting price of $800.00 or a Buy It Now price of $900.00 for his item.
Whatever the item "sold" for, after eBay's greedy 10% selling fees, and possible PayPal charges, the crook may have been much better off selling the coins to us, instead of stealing our photographs.
Many eBay sellers seem to forget that they will have to pay 10% commission on the selling price, and possibly about 5% more in PayPal fees. If his sovereigns "sold" for £200 each, he would be lucky to receive £170 each, we will pay much more, unless the coins are stolen, damaged, or fake, any and all of which are likely on eBay.

Sherlock Holmes Needed
When eBay copyright thieves contact us to complain that we have reported their item listings, it very rare for them to tell us who they are. Usually we have to become detectives to find out. Sometimes there is a clue, but they are, as a class, absolutely useless and pathetic at communicating properly.
Having said that, gillesc54 was one of the worst cases of a stupid e-mail that we can remember seeing recently:

Subject eBay (sic)
Please could you tell me whatw (sic) as(sic) wrong with my sale? (20$ made of gold)
If we knew who you were, or the item number, or your eBay username, none of which you told us, we might be able to.
Of course you should realise unless you are moronically stupid, that it is because you stole our high quality photographs for your eBay listing.
Also, eBay should have passed on to the information we gave them for that purpose. They hardly ever do, so their dumb and dishonest members contact us, often being abusive, demanding to know why, and what the problem was. We believe that eBay should take some responsibility for the dishonest actions of their members, but our experience is that they take as little responsibility as possible, while claiming they take IP rights seriously, then, as standard, suggest and encourage their members to pester us for an answer.

Looking for Clues
The only clue that gillesc54 gave us was "gold $20". He did not specify from which country, and we would have guessed the U.S.A. Searching our sent e-mail NOCI reports would not have found this, it is only because we publish details on our websites naming and (theoretically) shaming eBay copyright thieves, that we had any way of tracing this one. The most recent gold $20 item was reported was the one shown on this page, so we were able to guess, with better than 90% certainty, which item he was referring to, and his eBay ID.

eBay Guilty of Negligence or Complicity
We will be reporting this example of copyright abuse using our standard Statutory Declaration via the eBay VeRO programme, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against eBay for their negligence and / or complicity if they fail to take down the offending material promptly.
