2707andreww eBay Copyright Thief - Stupid or Crook?
2707andreww, of Ipswich, Suffolk, United Kingdom, stole our beautiful high quality photographs of the reverse of a 1997 Gold Proof Golden Wedding Anniversary Five Pound Crown Coin to use on eBay, omitted to tell buyers that the image was not of the coin he was selling. Either stupid or a crook?
Our coin was a gold proof version, his was presumably the ordinary base metal circulation type.

1997 GOLDEN WEDDING ANNIVERSARY FIVE POUND CROWN COIN
In 1997, to commemorate the Golden Wedding of Queen Elizabeth II and Prince Philip, The Royal Mint struck a Limited Issue Proof £5 crown coin. The obverse has co-joint portraits of The Queen and Prince Philip, designed by Philip Nathan. The reverse design has the Royal Arms and Arms of Prince Philip surmounted by St Edward’s crown dividing the dates “1947”, “1997” and “20 November” and an anchor below with the denomination “five pounds” designed by Leslie Durbin. This legal tender coin is encased in a transparent hard plastic presentation case.

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin and bar images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
This particular eBay seller not only stole our coin images, he used it to sell his own coin on eBay. He did not seem to think it was worth mentioning to potential buyers that his coin was not the same coin as in our photographs. This is almost certainly illegal in the UK under the Trade Description Act, although it appears to happen on a daily basis on eBay.
It's possible he is ignorant of such fine points, or just plain ignorant.

It is always possible, even likely, that sellers who steal photographs do not own a similar item, and have the intention to totally defraud potential buyers.
The vendor is not only cheating us by stealing our copyright images, he is fraudulently or ignorantly misleading and deceiving all potential buyers. Gaining pecuniary advantage by deception is the definition of fraud.

Price
The seller was asking a starting price of £0.99 for his coin, which attracted a Winning" bid of £3.35 when we last checked it.
He probably would not have got the same price if he had used his own photographs, and he will have eBay Final Value Selling Fees to pay. He may have been better off selling to us.

eBay Guilty of Negligence or Complicity
We will be reporting this example of copyright abuse using our standard Statutory Declaration via the eBay VeRO programme, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against eBay for their negligence and / or complicity if they fail to take down the offending material promptly.
We also believe eBay fail to spell out sufficiently to new members about copyright, and we also accuse eBay of duplicity on this point.
